The Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65)
Under the mandate of California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65), consumer products that contain one or more carcinogens or reproductive toxicants at levels that result in exposures to consumers that exceed the “Safe Harbor” levels for those chemicals must be properly labeled before those products can be advertised or sold in California. Cal EPA publishes “Safe Harbor” levels (no significant risk levels [NSRLs] for carcinogens and maximum allowable daily intake levels [MADLs] for reproductive toxicants) in Sections 12705 (NSRLs) and 12805 (MADLs) of Title 22 of the California Code of Regulations.
